Products, Pricing and the FTC 30-Day Rule

Accuracy

We aim for perfect descriptions, but we often rely on information provided to us by the manufacturer, and cannot guarantee every manufacturer detail or color is exact.

Pricing and Taxes

Prices may not include sales tax; all applicable taxes and shipping costs will be clearly displayed at checkout.

Shipping Window

We typically process all orders within 20 minutes of being placed. We aim to ship all orders on the day they are placed or the morning after. Per FTC guidelines, if we cannot ship within 30 days, we will notify you and offer a full refund.

Returns and California Law Notice

Due to the nature of our products, we maintain specific policies designed to protect the health and safety of all customers and employees.

Hygiene Policy - All Sales Final on Opened Items

For health and hygiene reasons, sealed products cannot be returned or exchanged once the seal has been broken or the packaging has been opened. Once the shipping box has been opened, items may not be returned or exchanged. It is the responsibility of the customer to ensure they are ordering the correct product before completing their purchase.

Change of Mind - Unopened Items

If you change your mind before opening your order, you may return the item in its original, fully sealed condition within 30 days of purchase with proof of purchase, subject to the following:

• The shipping box and all internal packaging must be completely unopened and in original condition.
• You must contact us to initiate the return before sending any item back.
• A 20% restocking fee will be deducted from your refund.
• Original shipping fees are non-refundable.
• Return shipping costs are the responsibility of the customer. We recommend using a tracked service.

Cancellations

Once an order has been processed, we are unable to make additions, changes, quantity adjustments, or stop it from shipping.

Defective Products

If you receive a defective item, please contact our Customer Service team within 30 days of receipt. We will help you expedite a replacement through the manufacturer’s warranty process. You may also contact the manufacturer directly to submit a warranty claim. Applicable implied warranty rights under Nevada law (NRS 104.2314) and, where mandatory consumer protection laws of your state of residence apply and cannot be contractually waived, those rights are preserved and not waived by these terms.

California residents: California law provides implied warranties under Civil Code §1791. These rights are preserved to the extent required by California law, notwithstanding the Nevada governing law clause in these terms.

Store Credit

Store credit issued by Innov8 Solutions, Inc. expires after one (1) year of no purchase activity. Store credit has no cash value and cannot be transferred.

SMS

Customers that agree to receive Promotional marketing and Abandoned cart messaging from Pokey's World Store, do so with the understanding that message and data rates may apply, and that message frequency may vary. The customers' consent to receive the above mentioned messaging is not required as a condition of purchasing goods or services from Pokey's World Store. Abandoned cart reminders will be sent within 48 hours and be limited to one SMS/MMS per unique cart. Text the word HELP at any time for additional support or contact us by email at support@pokeysworld.com or at https://shop.pokeysworld.com/customer-service or by phone at 1(888) 592-4451 (001 415 423 2360). Text the word STOP at any time to stop receiving messaging from Pokey's World Store. Additionally, Pokey's World Store will not sell or share any information captured via SMS campaigns to third parties for marketing purposes.

To the maximum extent permitted by applicable law, in no event shall Innov8 Solutions, Inc. be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages. Any claim arising out of or relating to these terms or your purchase must be brought within one (1) year of the event giving rise to the claim.

Governing Law, Disputes and Arbitration

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. To the extent that any mandatory consumer protection laws of your state of residence apply and cannot be contractually waived, those laws are preserved solely to that extent.

Informal Resolution

Before initiating any formal dispute, you agree to contact us at support@pokeysworld.com and give us 30 days to resolve the issue informally. Most concerns can be resolved quickly this way.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, your use of our website, or any purchase — including questions about the validity, enforceability, or scope of this arbitration clause — shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in Clark County, Nevada, or, at your election, via videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND INNOV8 SOLUTIONS, INC. EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If this waiver is found unenforceable with respect to any claim, that claim shall be severed and proceed in court, while all remaining claims proceed in arbitration.

Jury Trial Waiver

To the extent any claim proceeds in court, YOU AND INNOV8 SOLUTIONS, INC. EACH WAIVE THE RIGHT TO A JURY TRIAL.

Exception - Small Claims

Either party may bring an individual claim in small claims court in Clark County, Nevada, provided the claim qualifies and remains in small claims court.

Severability

If any part of these terms is found unenforceable, it will be modified or removed only to the extent necessary, and the remainder will remain in full force and effect.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Innov8 Solutions, Inc. and supersede any prior agreements.
